The new IR35 rules are being introduced into the private sector construction industry in April 2021. IR35 is not a new piece of tax legislation, it has been in place since 2000, but the new rules will mean that construction companies will be responsible for assessing the tax status of any individual that provides their services using their own ‘PSC’ or ‘Limited Company’. This is currently the responsibility of the individual worker or contractor themselves.
As either a recruitment agency or ‘end hirer’ in the construction sector, the process of assessing the employment and therefore tax status of your contractor workforce is complex and time consuming. IR35 is a complicated subject and the new legislation is written in such a way that the tax man wants you to simply state that all of your ‘PSC’ contractors are caught by this tax legislation and 'inside IR35'.
